Term Rental Property Terms & Conditions |
By making payment
to Us or the property owner you agree on behalf
of all members of your group to our terms and
conditions as outlined. You acknowledge reading
and accepting our cancellation policy as stated.
Your agreement
Costa & Sierra is registered in Sanlucar
de Barrameda, Spain and trades under the NIE
number X-5437672-N. Whenever we mention “we”, “us” and “our” in
this agreement, it means Costa & Sierra.
This agreement confirms the booking conditions
and terms which automatically come into force
once you pay the first deposit to Costa & Sierra
or a property owner. You will be accepting
these conditions on behalf of all members of
your party and you must inform them of these.
When you make a booking and/or complete our
booking form you guarantee that you have the
authority to accept and do accept on behalf
of your party the terms of these booking conditions.
You agree to make all payments within the specified
time limits, including the breakage deposit.
You also agree to pay for all breakages and
to vacate the property at the agreed time at
the end of the rental period. You must be at
least 18 years old to make a booking with us.
We both agree that Spanish Law and jurisdiction
(and no other) will apply to our agreement.
We both also agree that any dispute, claim
or other matter of any description which arises
between us, if not settled between you and
us, must be dealt with by the Spanish Courts
within the town Sanlucar de Barrameda.
Pricing
Prices are quoted per property for short term rentals
in Euros within the price period shown and are exclusive
of any transport arrangements. All prices include
our booking fee and inclusions mentioned in the
accommodation description. Any payments made by
credit/debit card will incur an additional 10% plus
VAT fee added onto the rental price. Each rental
includes gas, electricity, water and the assistance
of our staff during your check-in and your stay.
If your holiday falls across two different price
periods you will be charged at the more expensive
rate. Unless the accommodation indicates the contrary,
extra services are never included and have to be
paid locally. For example: extra change of linen,
additional cleaning, firewood, etc are not included.
Reservation, Confirmation and Payment Conditions
Reservations and availability queries can be made
through our website. Once availability is confirmed
by us, you will be asked to confirm your reservation
and will receive a request for payment. A first
payment of up to 50% (minimum 150 Euros) is needed
to confirm the booking. The time limit for receipt
of initial payment depends on the property and will
be advised by us. If the deposit is not received
by the date indicated, we will cancel the booking.
The confirmation of the reservation we send you
will confirm the dates, price and reference number
of the accommodation reserved.
This information should be carefully checked by you, as this forms the basis
of our contract with you. Any questions regarding the reservation must be referred
back to us within 7 days of deposit payment. Any changes to accommodation requested
at a later time will be subject to the amendment and cancellation charges mentioned
below.
All remaining charges plus security deposit are payable either in cash at time
of check-in or 45 days before your arrival date. Whether you pay cash on arrival
or full payment before arrival is at the sole discretion of the property owner
and is not negotiable.
For last minute reservations made 45 days or less before arrival date, payment
may be due in full immediately. In this case the contract conditions come into
force once the full payment has been received. For earlier bookings, the final
balance may be due 45 days before arrival date. If the requested balance is not
paid in time we reserve the right to cancel your holiday, retain your deposit,
and apply the cancellation charges set out below. Any changes to your arrangements
will be confirmed in writing by us. You are responsible for ensuring your contact
details (home address, email & telephone numbers) are correct and current
at
all times. Should we need to contact you after your reservation has been made
and before your arrival, we will not be held responsible if we are unable to
contact you, due to incorrect or changes in your contact details. We will acknowledge
all emails we receive from you.
Additional costs with regard to payments received
by bank transfer etc will be borne by you.
Exchange rates between the Euro and any other currency
will be fixed by Costa & Sierra and are
not negotiable.
For reservations with a cost of 1000 Euros or more,
we are not permitted to accept any payment in cash.
Changes or cancellation charges
If you have to cancel your holiday the following
cancellation charges will be payable.
If the property owner has been paid the deposit
directly by you, we will do everything possible
to obtain a refund on your behalf, but we cannot
guarantee being able to obtain a refund for you.
You can cancel before 23:59 of the DAY and MONTH
PREVIOUS to your date of entry, we will refund the
money, less the administration fee of 25 Euros.
For example, your reservation with the day of entry
is December 5, 2023, you can cancel up to 23:59
p.m. on November 5, 2023. Cancellation later will
entail a cancellation cost of 100% of the total
rental value.
If you wish to change your booking to other
dates, the above cancellation charges will
still be applicable although we will contact
the owner of the accommodation and try to avoid
the charges. If we succeed, a 25 Euro administration
fee will apply for each change we are able
to confirm.
Costa & Sierra is not responsible for cancellation
due to circumstances beyond its control which
shall include bad weather, strike, natural
disasters, disease,
death, war, acts of terrorism etc, (non exhaustive list).
Arrival & Departure
On your arrival day, your arrival should be between
15.00 and 21.00 hours, any exceptions to this should
be agreed with us beforehand where we will contact
the key-holder to see if another arrangement can
be made. However, please note that we cannot guarantee
that such an arrangement will be possible. An additional
charge of 30 Euros will be levied for arrival between
21.00 and 23.00. Arrival after 23.00 is not possible.
If you are delayed on the day of arrival, you must
contact the key-holder to advise of your late arrival.
We cannot guarantee that keys will be available
outside of the above times and you may have to find
hotel accommodation and wait until the following
day. If you are unable to occupy the accommodation
on the stipulated arrival date due to delays, illness,
personal reasons etc your reservation will still
be deemed to commence on your original arrival date.
No refund or compensation can be made for the days
forgone nor can your stay be extended beyond your
original departure date. You will still be liable
for the full cost.
On your departure day, you should vacate the accommodation
by 10.00 hours or the agreed time in writing. The
keys will be collected or left securely inside the
property, the property inspected and we will process
the return of any security deposit as agreed when
your reservation was made. Late departure will incur
a charge of 3 times pro-rata day rate which shall
be deducted from the security deposit.
If you leave the property before your departure date you will not be entitled
to any refund or compensation.
On your arrival day or before you must present
passports OR identity documents and/or any other
relevant data required by law for every person in
your group.
Insurance
We strongly recommend that each member of your party has adequate insurance cover
including medical cover. Please read your policy details carefully and bring
them with you. It is your responsibility to ensure the insurance cover you purchase
is adequate for your particular needs.
Changes in conditions or prices
We try to ensure that property descriptions and
prices provided are correct. If we discover any
errors or changes you will be advised as soon as
possible. In the case of a major change, we will
offer you the option of accepting the alterative
accommodation or a full refund of all monies paid,
but no further compensation. Information about the
property facilities are provided in good faith but
we are unable to guarantee that all facilities will
be available at all times (for example access to
swimming pools). Community pool opening times are
generally from 15 June to 15 September.
If for any reason beyond our control, for example fire damage, death of the owner
or sale of the property and the property (or suitable alternative) is not available
on your arrival date; all monies paid in advance will be refunded in full.
We reserve the right to increase or decrease website prices at any time before
you book, however once your booking is definite and deposit paid, the price of
your holiday is guaranteed, with the exception of any taxes or charges which
may be implemented by the Spanish Government.
Your Liability & Security Deposit
Upon arrival at your accommodation, you should pay
the security deposit as mentioned in the confirmation
email sent by us. This amount is usually between
100 and 300 Euros, although it may be higher at
some luxurious properties. Please make sure you
are able to pay this amount in cash. Keys will not
be handed over until the deposit has been paid.
The deposit will be refunded on departure or shortly
afterwards via bank transfer, after deduction of
any charges for breakages, loss, late departure
charge or extra cleaning.
You must take care of the property and contents and respect the local rules.
If you break or damage anything in the accommodation you must advise the key-holder
or local agent immediately. You and your party will be liable for the cost of
repairs and replacements.
You must leave the house in exactly the same order as found upon arrival; empty
the dishwasher & fridge, wash and put away all kitchen utensils, clean fridge
oven, hob, microwave and BBQ before your departure. We reserve the right to deduct
a charge for cleaning from your security deposit should the property not be left
in the same condition as on your arrival.
Occupation of the property and use of its facilities
is strictly limited to the number of persons agreed
at time of reservation. The key-holder has the right
to refuse entry to extra persons or charge a supplement.
We reserve the right to refuse to accept you as
a customer or continue dealing with you if your
behaviour is disruptive or affects other holidaymakers
or is threatening or abusive towards us, our staff
or the accommodation provider.
The property can only be used for your temporary and tourist household needs.
You cannot make the property your new place of residence or choose it as your
permanent residence. Furthermore it is not allowed to sublet the property, or
parts of it to third parties.
Some of our properties have security alarms and
you must not tamper with the control panels. If the key holder is called to attend
the property by the alarm company for a non emergency you will be charged a call
out fee. Call outs during working days/hours will be charged up to 20 Euros for
each visit. Anti-social call-outs will be charged up to 50 Euros for each visit.
No animals are permitted in any property. We do
not permit parties or events in any of the properties.
Smoking is also not allowed within some properties,
this is restricted to smoking outside
Our obligations and liability
All properties on our database are privately owned and we act as letting agent
for the owners of the property. The renting conditions are transmitted to you
as received from the property owners. Any changes made to the property are the
responsibility of the owner and we can only accept responsibility if a complaint
results from the negligent acts of Costa & Sierra. If your complaint refers to an obligation of the owner of the property, Costa & Sierra
will act as an intermediary and will endeavour to find a satisfactory solution.
We cannot accept responsibility for any break in utilities, such as gas, electricity
and water, or any failure attributable to your own fault or party member or the
actions of third parties unconnected with the provision of services or Force
Majeure reasons. We do not accept responsibility in the event of death, bodily
injury or illness, which should in all cases be covered by your travel insurance.
We are not liable under any circumstances for loss, theft or damage to you and
your property or belongings.
Complaints
In case you have a complaint or problem during
your holiday you must inform Costa & Sierra
immediately who will endeavour to put things
right. We will immediately take steps to rectify
the situation. If we are unable to resolve the
problem to your satisfaction, you must confirm
your complaint in writing to us within 7 days
after departure. If you fail to follow this
procedure, we cannot accept responsibility as
we have been deprived of the opportunity to
investigate and rectify the problem. Except
where otherwise expressly stated in these booking
conditions we regret we, or the accommodation
providers, cannot accept liability or pay any
compensation for any damage or loss you suffer
where the performance or prompt performance
of our obligations under our agreement with
you is prevented as a result of "force majeure".
In these Booking Conditions, "force majeure" means
any event which we or the supplier of the service(s)
in question could not, even with
all due care, foresee or avoid. Such events
may include war or threat of war, riot, strike,
actual or threatened terrorist activity, industrial
dispute, natural or nuclear disaster, adverse
weather conditions, fire and all similar events
outside our control.
By confirming your reservation with us you
agree to our term and conditions as outlined.
You acknowledge reading and accepting our cancellation
policy as stated.
